1 Who we are and what these terms cover
NauticIQ is operated by Nautic Information Quality OÜ, a company registered in the Estonian commercial register under registry code 17606480. Our registered address is Jõe tn 3-303, Kesklinna linnaosa, Tallinn, Harju maakond, 10151, Estonia. In these terms, “we”, “us” and “our” mean that company.
Website covered: https://nauticiq.com and https://nauticiq.net. Contact us through the contact form, by email at [email protected], by phone at +372 699 1531, or at our registered postal address above.
These terms cover use of our public information website, including product information, pricing estimates, enquiries, demonstrations and downloadable materials. NauticIQ Ops, Operator Cockpit, Base360 and Axis360 are separate business services. Their use is governed by the applicable service agreement and order, not by these visitor terms. An operator's or agency's own website may have separate terms identifying its operator.
We make these terms available before any website action requiring your agreement. Where we require acceptance, we will ask you to confirm it. Visiting the website does not place an order, create a paid subscription, agree to marketing, or consent to optional cookies.
2 Product information and enquiries
The website describes our products and helps businesses assess whether they meet their needs. A demonstration, roadmap, indicative launch date or pricing calculation is not a commitment to deliver a particular feature or a binding quotation unless expressly included in an accepted order. We will not describe an unavailable feature as currently included.
Prices and calculations should be read with their stated currency, billing period, tax treatment, boat or user limits and other assumptions. We will provide the actual scope and charges before you enter a paid agreement. The accepted Order records the applicable price, billing period, included usage, any first-year promotion and subsequent renewal price. Later website changes do not change that Order. Where an error affects a quotation, we will explain the correction before seeking your acceptance. These terms do not allow us to change an already agreed price retrospectively.
Please provide accurate business contact details when requesting information. Do not submit passwords, payment card details, passport copies or confidential crew information through general enquiry forms. A request for a demo does not enrol you in unrelated marketing.
3 Permitted use
You may browse, link to our public pages, and retain reasonable copies of materials for evaluating our services or other purposes permitted by law. A link must not misrepresent an association with us or imply our endorsement. Permission to use the website does not grant a right to resell our software or reproduce our branding as your own.
Do not use the website to commit fraud, impersonate another person, send unlawful or harassing material, introduce malware, attempt unauthorised access, evade security controls or interfere with other visitors. Do not collect personal information about others without a lawful basis. Automated access must respect applicable law, access restrictions and reasonable service capacity; it must not bypass authentication, exploit vulnerabilities or extract protected content unlawfully. These restrictions do not remove statutory exceptions or rights that cannot lawfully be excluded.
If you discover a security issue, report it privately through the contact above, with enough information for us to investigate and without accessing or publishing another person's data.
4 Intellectual property and submitted material
The website, software descriptions, designs and other content are protected by intellectual property laws. Rights belong to us or the relevant licensors. Third-party names and marks remain those of their respective owners. No ownership transfer is made by these terms.
You retain your rights in information you send us. You give us permission to use it only as reasonably necessary to handle your enquiry, provide the requested response, and maintain appropriate records, subject to our Privacy Policy. Providing feedback does not transfer ownership of your confidential business information or authorise public use of your name or logo.
Do not send content you have no right to share. If you believe content on our website infringes a right or is unlawful, contact us with its location, your reasons, and supporting information. We will assess the report and take appropriate action.
5 Third party resources
We may link to independent resources or identify compatible third-party services. A link does not make us the provider of that service. Its provider is responsible for its own terms and conduct. Our responsibilities for an integration expressly included in a paid agreement remain governed by that agreement.
6 Website availability and restrictions
We use reasonable care in operating the website. Access may be interrupted for maintenance, security or technical reasons. These visitor terms do not provide a service-level guarantee for the public website or replace an agreed service level for a paid product.
We may restrict access where reasonably necessary to address unlawful use, a material breach of these terms, a security incident or a legal requirement. Measures will be proportionate to the issue. Where practicable and lawful, we will explain a restriction and allow you to request a review. A website restriction does not itself cancel a separate service agreement or remove rights under it.
7 Privacy and cookies
Our NauticIQ Website Privacy Policy explains how we handle visitor information. Our Cookie Notice and consent controls explain any optional technologies used. Privacy information is a notice about processing; agreement to these terms is not consent to every processing activity. You may withdraw optional consent through the stated controls.
8 Responsibility for loss
We are responsible for our own obligations and for losses for which applicable law makes us responsible. General product information is not a substitute for considering your own operational needs, but this does not excuse misleading statements or override express commitments we make.
Nothing in these terms excludes or limits liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence where liability cannot be excluded, or any other liability or remedy that cannot lawfully be limited. These terms do not remove mandatory consumer rights. Liability under a paid service agreement is addressed in that agreement; no separate monetary cap is imposed by these visitor terms.
9 Changes to these terms
We may update these terms to reflect changes to the website, our services or applicable law. We will identify the effective date and make the revised text available. Material changes affecting an ongoing website account or accepted arrangement will be communicated in advance where required. Updates apply prospectively and do not rewrite a previously agreed service contract or remove accrued rights. Where fresh agreement is legally required, we will obtain it.
10 Complaints and disputes
Contact us using section 1 and explain the issue and remedy you seek. We will review it fairly. Where Estonian consumer complaint rules apply, we will respond within 15 days or explain a justified delay and when we will respond. You may seek assistance from a competent consumer authority or dispute-resolution body without first giving up court remedies.
These terms are governed by Estonian law. If you are a consumer, this choice does not deprive you of mandatory protection provided by the law that would apply without this choice. You retain any right under applicable law to bring proceedings in the courts of your habitual residence or other competent courts. Business disputes may be brought before the competent courts of Estonia, subject to mandatory jurisdiction rules.
If one provision cannot be enforced, the remaining provisions continue to the extent lawful. A delay in enforcing a right is not a waiver. Translations should convey the same meaning; no language-priority rule displaces mandatory consumer protections or a language expressly agreed for a separate contract.
